The right to withdraw from the contract concluded outside the seat or at a distance

The right to withdraw from a contract
1. Pursuant to Article of the Consumer Rights Act, a Customer who is a Consumer has the right to withdraw from a distance contract without giving any reason.
2. The right to withdraw from the contract is valid for a period of 14 calendar days from the moment the Customer or a third party designated by them, other than the carrier, takes possession of the Goods.
3. To exercise the statutory right to withdraw from the contract, the Customer shall submit a clear declaration of intent to the Seller, sending it to the address: ul 70 Lecia Niepodległości 28 26-035 Raków, or to the Seller’s email address: biuro@undercarp.pl.
4. The Customer may use the withdrawal form – Declaration of Withdrawal from the Contract, which is Attachment No. 1 to the Terms and Conditions. Using the form provided by the Seller is not mandatory and does not affect the Customer’s right to withdraw from the Contract.
5. To meet the deadline specified in paragraph 2, it is sufficient to send the declaration of withdrawal from the contract electronically or to the Seller’s address before the deadline expires.
6. A Customer who has used electronic means to send the Declaration of Withdrawal from the contract to the Seller will be promptly informed of the acceptance of the declaration of intent via email or in writing to the address provided in the Order Form.
7. The Seller will refund to the Customer all payments received from the Customer, including the cost of delivering the Goods, without undue delay and in any event not later than 14 calendar days from the day on which the Seller receives the Customer’s declaration of withdrawal from the contract. The Seller will make the refund using the same means of payment as the Customer used for the initial transaction unless the Customer has expressly agreed otherwise, and there will be no additional costs for the Customer.
8. The Seller may withhold the reimbursement until the Goods are received back or until the Customer provides proof of having sent back the Goods, whichever is the earliest.
9. After withdrawing from the contract, the Customer is obligated to return the purchased Goods to the Seller or to a person authorized by the Seller to receive it immediately, no later than within 14 calendar days from the date of submitting the Declaration of Withdrawal.
10. In the case of a Customer who has chosen a method of delivery other than the cheapest standard delivery offered by the Online Store, the Seller is not obliged to reimburse the Customer for the additional costs.
11. The Consumer shall bear the direct cost of returning the Goods.
12. The Goods should be returned to the Seller’s address: ul 70 Lecia Niepodległości 28 26-035 Raków.
13. The Consumer is only responsible for any diminished value of the Goods resulting from the handling of the Goods other than what is necessary to establish the nature, characteristics, and functioning of the Goods.
